Welcome to Learnimal, an educational app designed for parents and their young children. This Privacy Policy explains how Learnimal ("we," "us," or "our") collects, uses, discloses, and protects information from and about our users, particularly children under the age of 13, for users globally.
By using the Learnimal app, you agree to the terms of this Privacy Policy. If you do not agree with our policies and practices, please do not use our app.
1. Information We Collect
We collect information to provide and improve our services, communicate with you, and enhance the app's functionality. The types of information we collect include:
Information You Provide Directly
- Parent/Guardian Information:
- Contact Information: Your name and email address.
- Demographic Data: Your selected region (e.g., US, UK) is collected as a specific data point for accent detection within the app.
- Payment Information: (If applicable for subscriptions). We do not directly store your full payment card details; this is handled by our secure payment processor.
- Children's Information (Entered by Parent/Guardian):
- Name: The name you provide for your child(ren) to personalize their in-app experience.
- Age: The age you provide for your child(ren) to tailor content appropriately.
- Reward Categories: Information about the active reward categories (e.g., images of horses, dogs, robots) you choose for your child(ren) within the app. These rewards are images shown to the child after successfully telling the parent the correct answer.
Information Collected Automatically
When you use the Learnimal app, we may automatically collect certain information about your device and usage through third-party analytics tools like Posthog and hosting providers like Vercel. This includes:
- Usage Data: Information about how you interact with the app, such as features used, the "funnel" or flow across the app, and generic app usage patterns.
- Device Information: Your device type, operating system, unique device identifiers, and mobile network information.
- IP Address: Your Internet Protocol address.
2. How We Use the Information We Collect
We use the information we collect for the following purposes:
- To Provide and Maintain the Service: To deliver the Learnimal app's functionalities, manage your account, and provide customer support.
- Communication: To communicate with you regarding your account, app updates, and respond to your inquiries.
- App Improvement: To understand how users interact with the app, identify areas for improvement, and make statistical decisions to enhance the user experience and content.
- Personalization: To personalize the app experience for your child based on their name, age, and your chosen reward categories. The region data helps with accent-specific content.
- Analytics: To analyze app performance, user engagement, and other metrics to inform product development.
- Security and Fraud Prevention: To detect and prevent fraudulent activities and ensure the security of our services.
- Legal Compliance: To comply with applicable laws and regulations.
3. How We Share and Disclose Information
We do not sell or "share" (as defined under California law for cross-context behavioral advertising) the personal information of our users, including children's personal information, with third parties for their independent marketing or advertising purposes.
We may disclose your information, including children's information, with the following categories of third parties only for the purposes described in this Privacy Policy:
- Service Providers: We use third-party service providers to help us operate, provide, and improve our services. These include:
- Analytics Providers (e.g., Posthog): For analyzing app usage and performance.
- Cloud Hosting and Database Providers (e.g., Vercel, Supabase): For storing and processing data securely.
- Payment Processors: For handling subscriptions and payments (if applicable).
These service providers are contractually obligated to protect your information and use it only for the purposes for which we disclose it to them.
- Legal Requirements: We may disclose your information if required to do so by law or in the good faith belief that such action is necessary to:
- Comply with a legal obligation (e.g., subpoenas, court orders, regulatory requests).
- Protect and defend our rights or property, or the safety of our users or the public.
- Prevent or investigate possible wrongdoing in connection with the service.
- Protect against legal liability.
- Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or other sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on our app of any such change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
4. Children's Privacy
Learnimal is an app designed for parents of small children, and we are committed to protecting children's online privacy in accordance with applicable laws worldwide, including the Children's Online Privacy Protection Act (COPPA) in the United States and relevant provisions of the General Data Protection Regulation (GDPR) in Europe.
- Parental Control: The Learnimal app is intended for use by parents who create accounts and input their children's names and ages. Children do not use the app independently and do not have direct access to input personal information.
- Parental Consent: When you create an account and input your child's name and age, you affirm that you are the parent or legal guardian of the child and consent to our collection and use of this limited personal information about your child as described in this Privacy Policy.
- Important Note on Verifiable Parental Consent: Please be aware that our current method of obtaining consent relies on your affirmation as a parent or legal guardian during registration. While we take reasonable steps, this method may not meet the "verifiable parental consent" requirements for children under 13 as outlined by certain stringent privacy laws (e.g., using a credit card, verified phone call, or signed form). We encourage parents to be vigilant about their child's online activities. We are continually evaluating methods to strengthen our consent mechanisms.
- Data Collected from Children: We collect only the child's name, age, and activity related to parental choices of reward categories and progress within the app. We do not allow children to publicly post or share personal information. We do not collect sensitive child data (e.g., photos, voice recordings, precise geolocation, free-text input by the child).
- Parental Rights: Parents have the right to:
- Review the personal information collected from their child.
- Direct us to delete their child's personal information.
- Refuse to permit further collection or use of their child's information.
Parents can exercise these rights by contacting us via email at legal@learnimal.com. We may require you to verify your identity before fulfilling such requests.
5. Data Security
We implement reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect from unauthorized access, use, alteration, and destruction. All data is stored securely in the cloud (Vercel, Supabase) with their respective security measures in place. However, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee its absolute security.
6. Data Retention
We retain personal information for as long as your Learnimal account remains active. As there is no in-app feature to delete your account, your data will persist unless you explicitly request its deletion by contacting us via email.
Upon receiving a valid deletion request via email, we will delete or anonymize your personal information within a reasonable timeframe, typically 1 year, unless a longer retention period is required or permitted by law (e.g., for financial records, fraud prevention, or to resolve disputes). Please note that data retained by our third-party service providers (Posthog, Vercel, Supabase) will be subject to their respective data retention policies.
7. Your Rights and Choices
Depending on applicable privacy laws in your jurisdiction, you may have certain rights regarding your personal information. These rights may include:
- Right to Access: You may request a copy of the personal information we hold about you.
- Right to Correction/Rectification: You may request that we correct any inaccurate or incomplete personal information we hold about you. You can directly edit your name and your children's names and reward categories within the app.
- Right to Deletion (Right to be Forgotten): You may request that we delete your personal information. Please note: As there is no automatic account deletion feature in the app, you must submit a deletion request via email to exercise this right. Your data will remain active until such a request is processed.
- Right to Object to Processing: You may object to our processing of your personal information for certain purposes (e.g., analytics).
- Right to Data Portability: You may request to receive your personal information in a structured, commonly used, and machine-readable format.
To exercise any of these rights, please contact us only via email at legal@learnimal.com. We will respond to your request in accordance with applicable law and subject to verification of your identity.
8. Cookies and Tracking Technologies
We use cookies and similar tracking technologies for authentication and analytics (via Posthog).
- Cookies: Small data files stored on your device that help us remember your preferences, facilitate login, and understand how you use the app.
- Third-Party Cookies: Posthog uses cookies to collect usage data for analytics purposes.
Important Note on Cookie Consent: We do not currently use a cookie banner or consent management platform to obtain explicit consent for non-essential cookies. By using Learnimal, you consent to the use of cookies as described in this policy. Please be aware that in certain jurisdictions (e.g., the UK, EU), explicit opt-in consent may be required for such cookies, and our current practice may not fully meet these requirements.
9. International Data Transfers
Learnimal's primary servers are located in the US (Posthog in Virginia, Supabase in US-East). While Vercel operates on an "edge cloud" network, meaning data may be processed and stored in various locations globally by our third-party providers for performance optimization, the core data storage is primarily within the United States. By using Learnimal, you understand that your information may be transferred to, stored, and processed in the United States and other countries that may not have data protection laws equivalent to those in your country of residence. We strive to implement appropriate safeguards for international data transfers in accordance with applicable legal requirements.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. We will notify you of any material changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. We encourage you to review this Privacy Policy periodically for any changes.
